| Information provided to a shareholder outside the general meeting pursuant to Art. 428 § 6 of the Commercial Companies Code The Management Board of mBank S.A. ("Bank") informs that on March 26, 2024, at the request of a shareholder, it provided the following information about the company outside the general meeting: In the financial statements of the Bank, the consolidated financial statements of mBank Group and the Management Board's report on the activities of mBank Group for 2023, the Bank did not take into account the lawsuit brought by a shareholder requesting information. In the Bank's opinion, the risk of the Bank losing the lawsuit brought by a shareholder is negligible (less than 5%) and for this reason the proceedings are not treated by the Bank as significant. For the above reasons, the Bank did not create a provision for the legal risk related to this case and did not include information on the ongoing proceedings in the financial statements for 2023 or for previous years (i.e. 2021 and 2022), as well as in the Management Board's report on the Group's activities. mBank for 2023 and 2021 and 2022.
